1. Accuracy of content
To the extent permitted by applicable law, Schoople disclaims all representations and warranties, express or implied, that content or information displayed in or on our site is accurate, complete, up-to-date and/or does not infringe the rights of any third party.
2. Using Schoople Services
As a user of a Schoople service, you agree that you are at least 18 years old and fully able and competent to enter into legally binding contracts.
As a representative or administrative contact for a school/club, you also agree that you have the authority to represent that school/club and make decisions relating to the services you use on behalf of that school/club.
Your username and password enables you to login to your account and control the services available to you. Please keep these in a safe place. If you think that someone else may either know or be using your username and password, please visit your user account page when logged in and change your login details.
We reserve the right to decline or suspend your account at any time and at our sole discretion.
Our site is made available free of charge.
We do not guarantee that our site, or any content on it, will always be available or be uninterrupted. Access to our site is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of our site without notice. We will not be liable to you if for any reason our site is unavailable at any time or for any period.

If you (being a school/club) sign up to services which require you to provide your bank details for the processing of payments due to you, then you are responsible for ensuring that those details are and remain correct and we shall not be liable to you or any third party for any loss that you or any third party may suffer as a result of such details being incorrect save for in connection with our fraud or the fraud of any of our employees.
If you are signed in to Schoople with administrative permissions for a school/club account, you are responsible for ensuring that any account details entered or amended shall be with the full authority and knowledge of that school/club and that the decisions/actions you make on the account are in the best interest of the school/club.
You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these terms of use and other applicable terms and conditions, and that they comply with them.
3. Copyright
All rights, including copyright, in the content of the Schoople web pages are owned or controlled by Schoople. In accessing web pages, you agree that you may only download the content for the purpose of administering services for your own individual use. You are not permitted to copy, broadcast, download, store (in any medium), transmit, show or play in public, adapt or change in any way the content of the Schoople web pages for any other purpose whatsoever without the prior written permission of Schoople.
If you print off, copy or download any part of our site in breach of these terms and conditions, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
4. Links to other websites
Schoople have placed links to other third party websites we think you will want to visit not operated by Schoople. The links are provided for your convenience. We do not vet these websites and do not have any control over their content. Schoople cannot accept any liability in respect of the use of these websites.
Please be aware that we are not responsible for the privacy practices, or content, of these third party sites. We encourage our users to be aware when they leave our site and to read the privacy statements of third party sites. You should evaluate the security and trustworthiness of any other site connected to this site or accessed through this site yourself, before disclosing any personal information to them.
5. Linking to our site
You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.
You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
You must not establish a link to our site in any website that is not owned by you.
Our site must not be framed on any other site, nor may you create a link to any part of our site other than the home page.

Depending on the third party services you choose to use, we may pass information relating to your account and the decisions you make in controlling the third parties’ service(s) to the respective third party service provider (if any), so that they can meet their obligations to you effectively.

Opinions expressed or materials provided by third parties that appear on Schoople web pages are not necessarily shared or endorsed by us and we should not therefore be regarded as the publisher of such opinions or material.

Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.
We exclude all representations, warranties, conditions and terms (whether express or implied by statute, common law or otherwise) to the fullest extent permitted by law. We accept no liability for any losses or damages which are not reasonably foreseeable arising out of or in connection with these Terms and conditions or links to other websites.
Except to the extent required by applicable law, Schoople shall not be liable to any person or entity for any loss or damage which may arise from the use of or reliance on any content or information displayed in or on our site.
Your use of any information on our site is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through linked websites and services meet your specific requirements. We have no responsibility for the content of the linked website(s). The information on our site is provided on an "as is" basis. To the fullest extent permitted by law, Schoople excludes all representations and warranties relating to our site and its contents or which is or may be provided by any affiliates or any other third party, including in relation to any inaccuracies or omissions in our site and/or our literature; and excludes all liability for damages arising out of or in connection with your use of our site. 10. Confidentiality
We are registered under the Data Protection Act 1998 and as such, any information concerning the User or the entity the User represents and their respective records may be passed to third parties. Users have the right to request sight of, and copies of any and all records we keep on them, on the proviso that we are given reasonable notice of such a request. Users are requested to retain copies of any literature issued in relation to the provision of our services.

11. Force Majeure
Neither party shall be liable to the other for any failure to perform any obligation under any Agreement which is due to an event beyond the control of such party including but not limited to any Act of God, terrorism, war, Political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or man made eventuality outside of our control, which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen. Any Party affected by such event shall forthwith inform the other Party of the same and shall use all reasonable endeavours to comply with the terms and conditions of any Agreement contained herein.
12. Governing Law
This contract is subject to English law and the exclusive jurisdiction of the English courts. If any provision of these disclaimers and exclusions shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
LIKING OR NOMINATING SCHOOPLE SERVICES
Throughout the course of visiting our site, you may choose to 'like' or 'nominate' a particular service in respect of your school or club. We collect these nominations and, when there is sufficient numbers, notify the account holder of that school/club of the number of nominations received. This can help encourage them to try give the service a go.
Your use of this feature is in accordance with the following additional terms.

- nominated school/club, as detailed on the nomination page, registers an admin account with us; or
- nominated service, as detailed on the portal page, is activated by your school/club
- So that we may provide such notification to you we will store the email address you submit on the portal page and the details of the nominated school/club.
- By submitting such request and accepting these terms and conditions you are authorising us to contact you by email at the address submitted on the portal page in order to notify you as detailed at paragraph 1 above.
- From time to time we, members of our group of companies or selected third party partners may wish to contact you regarding other products and services which may be of interest to you.
By accepting these terms and conditions you are authorising such persons to contact you by email at the address submitted on the sign up page regarding such products and services. You may opt out of such emails at any time using the unsubscribe facility included within the emails that we may send or by contacting us at contact@schoople.com .
You have the right to ask us not to process your personal data for marketing purposes. You can exercise the right at any time by contacting us at contact@schoople.com .

ACCEPTABLE USE
This acceptable use policy sets out the terms between you and us under which you may access our site. This acceptable use policy applies to all users of, and visitors to, our site.

We may from time to time provide interactive services on our site, including message boards.

We will do our best to assess any possible risks for users (and in particular, for children) from third parties when they use any interactive service provided on our site, and we will decide in each case whether it is appropriate to use moderation of the relevant service (including what kind of moderation to use) in the light of those risks. However, we are under no obligation to oversee, monitor or moderate any interactive service we provide on our site, and we expressly exclude our liability for any loss or damage arising from the use of any interactive service by a user in contravention of our content standards, whether the service is moderated or not.

- Be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety.
- Be likely to harass, upset, embarrass, alarm or annoy any other person.
- Be used to impersonate any person, or to misrepresent your identity or affiliation with any person.
- Give the impression that they emanate from us, if this is not the case.
- Advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.
4. Suspension and termination
We will determine, at our discretion, whether there has been a breach of this acceptable use policy through your use of our site. When a breach of this policy has occurred, we may take such action as we deem appropriate.
Failure to comply with this acceptable use policy constitutes a material breach of the general terms of use upon which you are permitted to use our site, and may result in our taking all or any of the following actions:
- Immediate, temporary or permanent withdrawal of your right to use our site.
- Immediate, temporary or permanent removal of any posting or material uploaded by you to our site.
